Terms & Conditions of Sale, Use & Refund

1. Introduction

By interacting with, purchasing from, or receiving services from Dong Fang Waterproof Sdn. Bhd. (“the Company”), you agree to abide by the following Terms & Conditions. These terms apply to all product sales, technical guidance, deliveries, warranty assistance, and marketing content issued by us.

Dong Fang Waterproof Sdn. Bhd. is the exclusive sole distributor of Oriental Yuhong waterproofing products in Malaysia. As a distributor, we act in accordance with the product specifications, warranties, and performance parameters determined by the manufacturer.

The Facebook page at https://www.facebook.com/orientalyuhongmy is officially owned and managed by Dong Fang Waterproof Sdn. Bhd.. It is used to promote our partnering brand Oriental Yuhong in Malaysia. The page name is subject to change if or when the distributorship arrangement with Oriental Yuhong ends.

2. Product Information & Responsibility

All technical advice, method statements, and product documents provided by the Company are based on manufacturer-issued specifications. While Dong Fang Waterproof may offer application suggestions or site guidance, the responsibility for correct usage, storage, and site compliance lies with the customer and/or applicator.

The Company is not liable for:

  • Improper application or workmanship not in accordance with guidelines

  • Use on unsuitable substrates or surfaces

  • Storage beyond recommended conditions

  • Compatibility with other construction materials or coatings

In any case, the Company’s total liability shall not exceed the invoiced value of the supplied goods.

3. Quotations & Order Acceptance

All quotations are valid for 14 calendar days unless otherwise stated. Orders are only accepted once confirmed in writing or upon delivery note/invoice issuance. The Company reserves the right to accept, reject, or cancel orders without obligation to disclose reasons.

4. Pricing & Payment Terms

  • Prices are in Ringgit Malaysia (RM), exclusive of SST and transportation, unless stated.

  • Payment must be made based on agreed terms. Delayed payments may result in delivery suspension or order rejection.

  • No withholding or set-off is permitted without written consent.

5. Delivery & Inspection

  • Goods will be delivered according to agreed schedules where possible, but delivery times are estimates and not guaranteed.

  • Customers are responsible for inspecting goods immediately upon receipt. Any damages or short supply must be reported within 48 hours.

  • Failure to notify within this period constitutes acceptance of goods in good condition.

6. Refund Policy

Eligibility for Refund

Customers may be eligible for a refund under the following conditions:

  • The product is returned within [10] days from the date of purchase or within the terms and conditions stipulated on the official delivery order or any legal delivery document.

  • The product is unused, in its original packaging, and in resalable condition.

  • The product is received damaged upon opening the sealed packaging

  • The product is found to be past its shelf life upon delivery.

  • The product is defective or does not work.

Non-Refundable Items
The following items are non-refundable:

  • Products that have been used or altered.

  • Custom or special-order items.

  • Products purchased in satisfactory condition prior to their expiration date and stored until expiration are not eligible for refund. Additionally, if these products are found to be damaged upon use after expiration, they are also not eligible for refund.

  • Products that show issues due to incorrect application methods that do not comply with our product method of statement.

Process for Requesting a Refund

To request a refund, please follow these steps:

  1. Contact Customer Service
    Reach out to our customer service team at 012-9680696 or dongfangwaterproof@gmail.com to initiate the return process.

  2. Submit the following information:

    • Proof of purchase (an official receipt/invoice).

    • Dealer name from whom the product was purchased.

    • Reason/explanation for the return.

    • Damaged/defective products (expired, defect, quality issue): Provide product QR code and proof such as photos/videos.

  3. Receive Return Authorization

    • Upon verification, a Return Authorization Number (RAN) will be issued. This must accompany the returned goods.

  4. Return the Product

    • Send to:

    • Package securely; we recommend using a trackable shipping method.

  5. Inspection & Processing

    • We will inspect and confirm refund eligibility.

    • If approved: product will be replaced, exchanged, credited, or refunded to the original payment method within 14 days.

Shipping Costs

  • Return shipping is borne by the customer unless due to product defect, damage, past shelf life, or our error.

  • Original shipping cost is non-refundable unless the fault lies with Dong Fang Waterproof Sdn. Bhd.

Exceptions

Partial refunds may be granted subject to management review and discretion.

7. Warranty Policy

Dong Fang Waterproof Sdn. Bhd. honors warranties within the terms set by the manufacturer, Oriental Yuhong. Any product-related performance issues will be subject to technical review, and may require verification by the factory.

Workmanship warranties are only valid if a written agreement is signed with a certified applicator or project contractor. Dong Fang Waterproof does not warrant third-party workmanship.

8. Intellectual Property & Use of Brand

All logos, images, brochures, and technical documents published by Dong Fang Waterproof or related to Oriental Yuhong are protected intellectual property. Unauthorized reproduction, alteration, or misuse of such materials is strictly prohibited.

Resellers and dealers are not permitted to use the Oriental Yuhong brand name for independent marketing unless written consent is granted by Dong Fang Waterproof.

9. Indemnity Clause

Customers agree to indemnify and hold Dong Fang Waterproof harmless from any claim, damage, or liability arising from:

  • Use of the product outside specified conditions

  • Installation by third-party contractors

  • Misuse, misapplication, or alteration of supplied materials

10. Force Majeure

The Company shall not be held responsible for delays, non-delivery, or non-performance caused by circumstances beyond its control, including but not limited to natural disasters, transport strikes, or manufacturer disruption.

11. Governing Law

These Terms and Conditions are governed by Malaysian law. Any dispute arising shall be resolved in the courts of Malaysia.
